1. Acceptance of Terms

By downloading, installing, or using the PixoBuild mobile application ("App"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, do not use the App.

2. Description of Service

PixoBuild is a mobile application that:

• Converts photos and 3D scans into building brick instructions
• Generates step-by-step 3D assembly guides
• Provides AI-powered model editing features (where available)
• Offers augmented reality (AR) build assistance

3. Eligibility

3.1 Age Requirements

• You must be at least 13 years of age to use this App.
• If you are between 13 and 18 years of age, you must have parental or guardian consent to use the App.
• Users under 13 may only use the App with verified parental consent and supervision, in compliance with the Children's Online Privacy Protection Act (COPPA).

3.2 Account Registration

• You must provide accurate, current, and complete information during registration.
• You are responsible for maintaining the confidentiality of your account credentials.
• You are responsible for all activities that occur under your account.
• You must notify us immediately of any unauthorized use of your account.

4. Subscription and Payment Terms

4.1 Free Tier

• The App may offer limited free functionality, including a specified number of scans per month.
• Free tier features may be modified or discontinued at any time.

4.2 Paid Subscriptions

• Premium features require a paid subscription.
• Subscriptions are billed through Apple's App Store.
• Subscription prices are displayed in the App and may vary by region.
• Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

4.3 Refunds

• Refund requests must be submitted through Apple's App Store.
• We do not directly process refunds for App Store purchases.

4.4 Price Changes

• We reserve the right to change subscription prices with 30 days' notice.
• Price changes will not affect active subscription periods.

5. User Content and Conduct

5.1 Your Content

• You retain ownership of any content you create using the App (scans, models, instructions).
• By using the App, you grant us a limited license to process your content solely to provide the Service.
• We do not claim ownership of your original creations.

5.2 Prohibited Uses

You agree NOT to:

• Upload content that infringes on intellectual property rights
• Attempt to reverse engineer, decompile, or disassemble the App
• Use the App to create content that is illegal, harmful, or offensive
• Attempt to circumvent usage limits or security measures
• Use automated systems or bots to access the App
• Share your account credentials with others
• Use the AI features to generate inappropriate, harmful, or offensive content
• Attempt prompt injection or manipulation of AI systems

5.3 AI Feature Guidelines

When using AI-powered editing features:

• Prompts must relate to building brick modifications only
• Requests for inappropriate content will be blocked and may result in account suspension
• AI responses are generated automatically and may contain errors
• You are responsible for reviewing and verifying AI-generated modifications

6. Intellectual Property

6.1 Our Intellectual Property

• The App, including its design, features, and code, is owned by Adam Lewis.
• The PixoBuild name, logo, and branding are our trademarks.
• You may not use our trademarks without prior written consent.

6.2 Third-Party Attributions

This App utilizes:

• LDraw Parts Library — Licensed under Creative Commons Attribution License. Visit ldraw.org for more information.
• The LDraw file format is an open community standard for representing building brick models.

6.3 No Affiliation

• This App is an independent product and is not affiliated with any building brick manufacturer.
• All manufacturer trademarks are the property of their respective owners.
• References to brick sizes or colors are for compatibility purposes only.

7. Disclaimers and Limitations

7.1 Service Availability

• The App is provided "as is" and "as available."
• We do not guarantee uninterrupted or error-free service.
• Features may be modified, suspended, or discontinued without notice.
• AI features require internet connectivity and may be unavailable during high demand.

7.2 Accuracy of Instructions

• Generated building instructions are algorithmic approximations.
• We do not guarantee structural integrity or buildability of generated designs.
• Physical builds may require modifications from generated instructions.
• Brick counts and part lists are estimates and may vary.

7.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• We are not liable for any indirect, incidental, special, or consequential damages.
• Our total liability shall not exceed the amount you paid for the App in the 12 months preceding the claim.
• We are not responsible for third-party services, including payment processors or cloud providers.

7.4 Physical Safety

• Building bricks contain small parts that may pose choking hazards.
• Adult supervision is recommended for children under appropriate ages.
• We are not responsible for injuries resulting from physical construction of designs.

8. Privacy

Your privacy is important to us. Please review our Privacy Policy for information about how we collect, use, and protect your data.

9. Termination

9.1 By You

• You may terminate your account at any time through the App settings.
• Cancelling your subscription does not entitle you to a refund for the current billing period.

9.2 By Us

We may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraudulent activity
• Abuse the Service or other users
• Fail to pay subscription fees

9.3 Effect of Termination

• Upon termination, your right to use the App ceases immediately.
• We may delete your account data after termination.
• Provisions that by their nature should survive termination will survive.

10. Dispute Resolution

10.1 Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.

10.2 Informal Resolution

Before filing any legal claim, you agree to attempt to resolve disputes informally by contacting us at support@pixobuild.com.

10.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration.

11. Changes to Terms

• We may modify these Terms at any time.
• Material changes will be notified through the App or via email.
• Continued use of the App after changes constitutes acceptance.
• If you disagree with changes, you must stop using the App.

12. General Provisions

12.1 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the App.

12.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

12.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

12.4 Assignment

You may not assign your rights under these Terms. We may assign our rights without restriction.

14. Apple-Specific Terms

If you downloaded the App from the Apple App Store:

• These Terms are between you and Adam Lewis, not Apple.
• Apple has no obligation to provide maintenance or support for the App.
• Apple is not responsible for any claims related to the App.
• Apple is a third-party beneficiary of these Terms and may enforce them against you.

By using PixoBuild, you acknowledge that you have read, understood, and agree to be bound by these Terms of Use.
